Terms and Conditions
Thank you for inviting Chance to capture your growing Family. We are so happy to be able to provide you with our services during this special time in your family’s life. The Below agreement will run through what you can expect from hiring Chance Photographics for your photography session along with what we expect from you as the client to ensure the best possible outcome for your session.
INCLUSIONS
Session Time - this ranges from 20mins - 4hours depending on which session has been purchased
Props, Backdrops & Outfits can be supplied depending on the type of session that has been purchased.
Specific Inclusions will be outlined in the Chance Photographics session booking confirmation which you will receive at the time of booking in.
BOOKING FEES
All booking fees are required at the time of booking the session. If you are booking a package of sessions (itty, bitty baby/ bump to baby) the full fee is due at the time of the first session. Booking fees are non-transferable to other families.
RESHEDULING:
Should you need to reschedule your session last minute, a minimum of 3 days is required after that time all monies paid will be forfeit. Rescheduling can happen a maximum of 2 times, after this all monies will be forfeit.
CANCELLATION:
No refund is given for any services cancelled within 30 days of the Clients booking date. (With the exception of an infant loss) Services cancelled prior to the 30 days will receive a refund of all monies paid.
YOUR SESSION / COVERAGE:
Every reasonable effort will be made to take requested pictures, but no specific pose or photograph can be promised. Images determined by the photographer to be substandard or duplicated may be edited out. The Photographer will use her professional judgment and sole discretion to select which photos to deliver. Such selection shall constitute all images that will be made available to Client.
All members who are to be included in the session need to be in attendance and on time for the session. No re-shoots will be allowable. Additional fees will be required for sessions extensions.
It is agreed that the client arrives on time and well groomed. Children should be dressed, hair neatly styled, clean face and hands. The photographer is not responsible for results of photos due to hair, makeup or wardrobe choice.
You participate in photography sessions at your own risk, any injuries prior to the session need to be told to the photographer before the beginning of the session.
Sessions involving younger children will be scheduled at appropriate times. eg (No kids under 2 after 2pm, no kids under 3 after 3pm etc.)
Chance Photographics is not liable for any person not be willing to participate in the session and the desired outcome not be achieved. Re-shoots will incur additional session fees should this be required.
SESSION COPYRIGHT:
During the session no photographs will be taken by the client of any setups or poses without the expressed consent of the photographer at the time.
VIEWING/ PURCHASING APPOINTMENT
Your Viewing/ Purchasing appointment needs to be scheduled no later than 2 weeks from the date of your photography session.
All decision makers must be in attendance for the viewing. Should all decision makers not be present, then the viewing will need to be rescheduled. For cancellation or rescheduling of the viewing this will incur a $50 fee each time. This covers the loss of the appointment time and the Photographers time.
VOUCHERS & COMPETITIONS
All Vouchers and Competition prizes are not to be used in conjunction with any other offer. All voucher and prizes are only able to be used on full prices sessions and products.
LIMIT OF LIABILITY:
In the unlikely event that the photographer is injured or becomes too ill to photograph the session, Chance Photographics will make every effort to reschedule the session to a suitable time for the client. Should the photographer become unable to perform the required session in a reasonable period of time Chance Photographics will assist the Client in finding a replacement photographer. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the photography package.
Chance Photographics takes the utmost care with respect to exposure, transportation, and processing the photographs. However, in the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond Chance Photographics’ control, Chance Photographics’ liability is limited to the return of all payments received for the photography package.
COPYRIGHTS:
The photographs produced by Chance Photographics are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner without Chance Photographics’ explicitly written permission. Upon purchase of the digital files by the client, limited copyright ownership of the resulting images will be transferred to the client under the following conditions: The digital negatives or prints are the property of the Client for personal use and for the purposes of the reproduction and giving of photographs to friends and relatives and not to be used by the client for profit or commercial use.
Chance Photographics as the right to use any image for display, publication, or other purposes; however we will honour any requests of the family for using, or not using certain images when necessary.
GALLERY COPYRIGHT:
The Image galley supplied to the client to make their choices of items is protected by Copyright held by Chance Photographics and may not be used without permission from Chance Photographics and/or the owner.
No screen shots of this gallery are permitted to save or share online without the written permission of Chance Photographics.
DIGITAL FILES:
Upon receipt of any photo USB containing digital files; the Client accepts all responsibility for archiving and protecting the photographs. Chance Photographics does not permanently archive image files. Files are kept by Chance Photographics for 12 months from the time of capture. Chance Photographics is not responsible for the lifespan of any digital media provided or for any future changes in digital technology or media readers that might result in an inability to read files provided. It is Clients responsibility to make sure that digital files are copied to new media as required.
MODEL RELEASE:
The Client hereby grants to Chance Photographics and its legal representatives and assigns the irrevocable and unrestricted right to use and publish photographs of the Client or in which the Client may be included, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The Client hereby releases Chance Photographics and its legal representatives and assigns from all claims and liability relating to said photographs. The above agreement also covers Minors who are under the legal guardianship of the Client who appears in the captured photographs or attends the session with the minor.

COMPLETION SCHEDULE:
Digital processing may take up to four weeks to complete. Please note that print and product prices are subject to change without any prior notice.
Should your Purchase be delayed, Chance Photographics will inform you as soon as possible and make sure the items are delivered within a reasonable time frame where they are able to do so.
